Surely, there have been few more compelling issues in any election than the question whether the president of the United States may, on his own, and in contravention of both domestic and international law, order the torture of people in the custody of the United States, and in the name of the people of the United States.

I would like to clarify the meaning of in the custody of the United States here. Does this phrase relate to people who are in American jails, or to the president who orders the torture while being under the protection of the United States?
