How should I say this?
Can I get this dish with /in the menu or can I not take this dish if I take this menu?

There are several ways to say it, but none of them can be so ethereally abstract as what you have written. You need to be more specific.

Do fries come with the burger (or not)?
Do you get potatoes with the chicken (or not)?
Is dessert included with the veal roast?

I suspect that he's ordering a set menu at a restaurant (often called a prix fixe) and wants to know if a substitution would be allowed.

In which case he'd want to say something like "May I substitute <x> for <y>?".

Past a certain point, I prefer not to have to guess. In my opinion, it's better if the person just tries to tell us in another way.
