If that were the case/if that was the case

I know what you would have said. You would have retorted that he was working for the government. If that were the case (If you would have retorted that), I would have said that a lot of NGOs support his claim.


Can we replace "if that were the case" with "if that was the case"? Why? I am not sure if past subjunctive and past are both valid in here. I think so, but I am not sure, but I think "were" is ok, but not "was", because it didn't happen yet, and it might not be able to be confirmed (the person could have said "I don't know".
