I'd rather (that)...than that...

(1) I'd rather (that) he hired a taxi than that he drove my car.

At the bottom of page 952, the CGEL says the first that is optional, but the second one is obligatory in (1):

Q1. Do you agree?

Q2. Can I use bare infinitive froms "hire" and "drive" instead?
