I cannot state as fact...

Hi

Could you please tell me which one of these is better? fact or a fact? Is the underlined sentence natural? Any suggestions are welcome.

I cannot state as fact that he saw us there. To me, our eyes did meet.

I cannot state as a fact that he saw us there. To me, our eyes did meet.
