Help regarding a few sentence

1. He could wait till the due date or he could/can also put an end to the contract and claim for compensation.(can i use 'can' here instead of 'Could'? And if not, then why not?)

2. While assessing the damages to the aggrieved party caused due to breach of contract, the assessment should be done properly.
OR
while assessing the damages to the aggrieved party on account of breach of contract, the assessment............properly.
(are both of sentenc is good?, which is more appropriate?, if there are any mistakes, please rectify?)

3. He was unable to make caps from velvet for sale(caps) during the spring season. (is this sentence correct?, And also check my mistakes?)
