Help gravely needed

Here is the sentence:

Lisa whose parents have died in the crash is an orphan.

My question:

Why must it be "have died" rather than "died"?

(Notice the commas.) Present perfect because it is (presumably) a recent event, and her condition relates strongly to her present condition and the context of this statement.
