'have been shot' and 'was shot'

Hello, if someone was shot at and is now lying down there waiting for rescue, is this guy 'has been shot' or 'was shot' ? which tense is right? thanks.

I don't think either is necessarily wrong, ESL. It depends on the context of the utterance, not on your extra-contextual description of the situation. Both of these are perfectly OK and perfectly possible:

Q: What happened to that guy down there?
A: He was shot! (A simple-past-tense answer to the simple-past-tense question: statement of past fact.)
