Form vs Function

The first time I saw you, I was jumping up and down in the rain, being silly.



1. Do you think we need a comma before 'being'? Grammar tells me we do, but in speech there would be no such pause...



2. Is it a noun phrase (modified by a relative clause) functioning adverbially?
