Expression inquiry

Is it grammatically correct to say: he was sentenced with the death penalty.

Or should it be sentenced 'to', or both?

Well, that's rich, I must say, since I spend a large part of my time here telling people to do exactly that. In this case there is no indication in the question that this is intended to be a sentence rather than a phrase.

"sentenced with ..." does not sound idiomatic to me.
