Some people belive that there should be fixed punishments for each type of crime. Others, however, argue that the circumstances of an individual crime, and the motiviation for committing it, should always be taken into account when deciding on the punishment. Discuss both these views and give your own opinion.

The issue of whether it is acceptable to have set punishments for different crimes have recently been much debated. While some are of the opinion that fixed penalties would reduce the overall rate of crimes in societies, others argue that such an approach may lead to injustice and should be discouraged, which I also approve of.

The advocates of fixed punishments mainly claim that fixed punishments for different types of offends could have deterring effects for both criminals and those who commit a crime for the first time. If the criminals know that they would face fixed punishments and there would not be any way to work around them, they would absolutely reconsider their actions and think about their consequents in advance. Besides, such punishments would stop the would-be criminals from committing a crime for the first time. Thus, exemplary fixed punishments would result in safer societies with lower crime rates.

That said, there are strong arguments for flexible criminal laws. As a matter of fact, an offend may happen under different circumstances and with different motives. A good point in case is murder. On may kill a person by accident or in an attempt to defend himself or his family. This type of crime and offender should be convicted differently from those who deliberately kill people to, for example, steal their money. Similarly, Juveniles or those who have committed a crime for the first time should be given lighter punishments such as probation, so that they can avoid the harmful effects of being imprisoned and rehabilitate sooner. Therefore, if the highest level of justice is going to be maintained in the courts, the judges should have flexible laws at disposal for different types of crimes.

In conclusion, there are advantages and disadvantages to fixed punishments for different types of crimes. But, in my opinion, the drawbacks of such an approach outweigh its advantages and should therefore be discouraged in order to prevent making arbitrary decisions in the court of law.
