English speaker, few grammar points

is quality of work correct?
1 He's the nicest employee but in term of the quality of work he produces, he's far from the best.

Is in regards correct here?
2 He was chosen to play for the team, in some regard because there aren't lots of tall players to choose from.

When to use each tense?
3 Why can't it be mine. Why couldn't it be mine. Why couldn't it have been mine.
