THE UK AND HUMAN RIGHTS LAW

Thank you for your recent reply to my email regarding the Positive Money Campaign. Your email was comprehensive and a pleasure to read. I am writing today regarding two separate issues:

1.
I am not a very nationalistic person, however, I can’t help but feel pride that the UK has great laws which protect the fundamental liberties of the citizens. I feel the Human Rights Act 1998 and the European Convention on Human Rights (ECHR) are expressions of us at our best and are at the heart of my positive identity of being British. They also represent a collective Europe, free of War. Therefore, it makes me sad to see the Conservative Party indicate their intent to water down the Human Rights Act and cut links to wider international Human Rights and this could be a possibility in the next parliament.

What are your views on the possible degradation of the Human Rights Act and similar laws? In your opinion, what is best way to protect these freedoms in the UK and Europe?

The second topic I want to discuss is section 3 of the Treason Felony Act 1848. This still active legislation makes it illegal to express views that the UK should be a republic and is in clear contradiction to the Human Rights Act 1998 and ECHR. I am not asking other people to share my view, only the right to freely hold or express a view in a peaceful manner.

From section 3 of the Treason Felony Act 1848:

“If any person whatsoever shall, within the United Kingdom or without, compass, imagine, invent, devise, or intend to deprive or depose our Most Gracious Lady the Queen, from the style, honour, or royal name of the imperial crown of the United Kingdom, ... to be transported beyond the seas for the term or his or her natural life”

I also find the Act’s 1900s language offensive, that a monarchy is above her subjects by virtue of being appointed by God and anyone in opposition, even to the idea of a monarchy should be banished. I am aware of the counter-argument that the law is just a relic of a past time and would never be used to prosecute today, however, it is still an intimidation for people who would like to freely express their views and a limit on their free speech (I am not trying to imply that there should be no limits on free speech, whatsoever).

What are your views on this matter and do you agree that at least this section of legislation should be remove from law?
