Does this law exist in USA?

Does this law exist and how would you write this?
You are allowed to defend yourself against an assault with (the same category weapon /a weapon of equal category) as your assailant or a weapon of below category. Should you use a weapon of higher category you could go to prison.
Thanks

Each state in the US has its own laws. In North Carolina, where I live, there is no such law as this. Assuming that you are an innocent victim, you can generally defend yourself with whatever you have available, including a more potent weapon than that of your attacker.

  • I don't know about other states, but it seems like a bad idea for a law.
  • If a 5'2" 120 lb woman were attacked by a 6'2" 220 lb man armed with a knife, would you want to say that she couldn't use a gun to defend herself?
