Is it "I don't believe that to be the truth" or "I don't believe that IT IS the truth"? I believe that both are legit and correct, but you HAD to pick one which one would you say is the more correct/legit one?

They do not have the same meaning. They would have equal meaning if they both used “that”: “I don’t believe that to be the truth.” “I don’t believe that is the truth.” (I prefer ‘to be’ version myself.)
