Customers have up to one month???

Please look at the following question.

[Q]Customers who purchase a new appliance from Mahmud's Home Store have ________ one month to exchange it.
(A) as of (B) within (C) up to (D) above

The correct answer is (C) up to. I want to ask you 2 things.

Q1) Why can I not use (B) within? Could you explain to me the reason?

Q2) "Up to one month to exchange it" is a preposition phrase and noun phrase. Please look at another example.
eg) "Neorela Electronics, whose entry you submitted on June 20, was selected from among 1,500 contestants"
Both of "Up to one month to exchange it" and " among 1,500 contestants" look preposition phrases and noun phrases.
Sometimes can preposition phrases be noun phrases?

I meant that 'within' which was optional in that sentence. 'up to' is not.

You have up to one month (within which) to exchange it.

You have up to one month = You have between one and thirty one days. Within that time period, you may exchange it.
