Correct Usage???

Is this a proper sentence?

"Jamie claimed to have faxed the invoice on Wednesday but neither Kate nor I has seen it."

I believe that technically it is correct, but I would risk life and limb to say "have" because of the word's proximity to "I". Most people would do the same, I think.

Agreement in a neither-nor structure is with the element nearest the verb, so it's ... neither Kate nor I have seen it.
