Correct this gramma for a Demend Letter, to insurance and a person at fault

I have this file and i just want some help i need to send this letter to the guy and the insurance company of the guy who i crahs with ... this is mainly informative and i requiere fast action as been while and i haven't receive any answer from them, also the bike is not at my house, the bike was impounded and is at the garage yard, and the police release the bike already...

I am writing about the accident on the 4th of December of 2011 , at Marybrook Road / Ocean Reef Road, Heathridge, STATE, COUNTRY . I am the owner of the motor vehicle Yamaha R1 Blue, with registration number PLATE which was damaged as a result of a collision with a vehicle owned by you with a registration number PLATE and droved by you on the above date. I am holding you liable for the damage to my vehicle. The bike is a written off and the cost of the bike has been assessed at $$$. I believe that your vehicle is insured with COMPANY.

My vehicle is available for inspection at the garage yard GARAGE ADRESS. Please forward a copy of this letter to your insurers as soon as possible.

If I do not receive a reply from you within 7 days of receipt of this letter I will instigate legal proceedings.

There are a few problems in your letter.

You say that Mr. Francis owned and drove the car on the 4th December, but you don't say that he was the driver who hit you. You have to be very explicit about who was at fault.

If you have police report, attached a copy. The insurance company will not accept the valuation in your letter since you were involved - it has to be something official. I would not put any dollar value in this letter, or tell them where the wrecked bike is. That will be the job of the insurance adjustor. Just ask Mr. Francis to have his insurance company contact you.

You do not claim any compensation for injuries - if your bike was totaled, I can't imagine that you were not injured. If you send this letter, Mr. Francis or the insurance company may use this letter as evidence to show that you are not claiming anything other than the value of your bike.

Finally, don't say "within 7 days of receipt of this letter" unless you are sending it by registered mail and have a signed and dated receipt. Otherwise, how will you know what date they receive it? Give a particular date, and ask when you can expect to be contacted by the insurance company. If you have the insurance policy number, just contact the insurance company directly. Be sure to have the police report to back you up.

Hello, thank you for your help, and yes you might have the reason, about the official document of the market value of the bike. but there is no where or somewhere official where I can find any official price for it, would you call something official a website of prices of bikes?

also about the injuries, yes I went to hospital, but i don't know if should i claim that aswell coz the Third Party insurance(Goverment) covers that, or i don't know,

and about the word

"Totaled" i think thats American English because in Australia "written off" is a word or term they use for vehicules or cars that are damaged and can not be driven anymore,

"intigate" and "initiate" what would be the difference?

Hi;

Instigate means to start a fight or a riot. (You instigate a riot by throwing stones. You instigate a fight by calling someone bad names or insulting his mother.)

Initiate means to start a process or a job.

If I were you, I would research your rights very thoroughly or talk to a lawyer before sending anything. Anything you send will be used against you in legal proceedings, and you do not know your rights or the law. You would be a sitting duck for Mr. Francis' lawyers.

The job of the insurance adjuster is to value damaged property for a claim, and to settle the claim with you. They will not accept a value that you state, no matter where you get it from.

When a vehicle is used, its value will greatly depend on its age and condition. Also, the replacement value (what you have to spend to get wheels again) will be higher than a sales value (what you could have sold it for). You have to find out what it would cost for you to replace the bike (sales tax, registration fees, inspection fees, etc.) - after all, that is what your real loss is. The insurance company values damage property all the time, and the best you can do it to be prepared to negotiate with solid research you have done. Businesses that are in the business of selling used bikes would be a good source. Get some sales contracts for a bike that is similar to yours. Or look up what bikes sold for on auction sites.

You should have a police report. Otherwise it's his word against yours regarding who was at fault. You should be contacted by the insurance company, and not have to deal with Mr. Francis at all.
