Correct conditional use here?

Sentence: She would be/would have been behind bars, like other culprits, had the jury attached more significance to her past record.

Question: Which conditional is correct to use here?

But, does not the former reflect "present-ness" instead of past likelihood there? Also, does not it make it odd with the "had"?
