Correct?

I just saw this headline on Bloomberg.

“If Roe is overturned, reproductive rights would disappear throughout the U.S.”

Is this sentence grammatically correct? Isn’t it supposed to be as follows?

If Roe were overturned, reproductive rights would disappear throughout the U.S.

If both are correct, what’s the difference between them?
