conditional?

1. A baby that is hungry will not stop crying.
(=A baby will not stop crying if it is hungry.)
2. A baby that was hungry would not stop crying.
(=A baby would not stop crying if it was hungry.)

I think both 'A baby's have generic reference,
so I can't see the difference between the two.
