Complain about/that

1-He complained that I was making too much noise.
2-He complained about my making too much noise.

Can 1 be used if I was indeed making too much noise and I knew it?
I think it would be used if I thought that I wasn't making too much noise, or if I did not know if I was making too much noise.

Does 2 imply that I was indeed making too much noise?
