common error

who can we use ARE with third form of verb like in sentence
wrong one = If the allegations made against him ARE FOUND to be true he could face rigorous imprisonment
correct one = If the allegations made against him ARE FOUND to be true he could face rigorous imprisonment
MY QUESTION IS WHY ARE USED WITH FOUND IT'S NEITHER A PASSIVE SENTENCE NOR ACTIVE ONE
