claims X, X claims

Hi,

Please which of the following uses is better?

1. The victim, claims the convict, was drunk.

2. The victim, the convict claims, was drunk.

N.B. Please I'm not interested in this sentence in particular but rather in the structure. I know there are better ways of saying it.
