"Cannot be X, but Y"

Is the following sentence complete and correct:

"He's a truthful man, and so his fantastic testimony cannot be an intentional lie, but an honest recollection of what he thought he had seen."

Or must I add:

"He's a truthful man, and so his fantastic testimony cannot be an intentional lie, but instead must be an honest recollection of what he thought he had seen."

I would just delete the comma:
