The topic:

Some people believe that there should be fixed punishments for each type of crime. Others, however, argue that the circumstances of an individual crime, and the motivation for commiting it, should always be taken into account when deciding on the punishment.

Discuss both these views and give your opinion.

My writing:

The extend of punishments for individual case of crime always requires justice and has to make sure to bring satisfactory to all involved subjects. It is believed by some people that every kind of crime should have a certain punishment which is not changeable. In contrast, others claim that it needs to be flexible when deciding on punishment by examining the motivation behind each circumstance. In my opinion, the second approach to solving crimes will ensure the most fairness since every factor and detail of each case are different from each other.

It is obvious that applying the same punishment on each type of crime can be time saving. In this way of solving the crime, the decision of punishment is based on the results of previous cases which were solved before. Each individual circumstance will be recorded and stored in law system in order to be used as references for other cases when that type of crime happens again.

However, we are acknowledged that individual instance of crime might not be the same, there are different motivation for committing which need to be put under consideration. This approach will give the council of judges deep understanding about the criminals and the reasons behind that. Therefore, the punishment can be adjusted to be appropriate to each case.

In my opinion, taking individual case into consideration is the best way to solve a crime. Furthermore, it is related to humanity matter when we look at the details closely and thoroughly to see the motivation behind the crime, then decide whether it should be dealt with forgiveness or not. For example, the punishment for a man committing theft because of his own purpose of getting rich is more severe than that for another poor man with the similar crime but because of his sick daughter.

In conclusion, applying fixed punishments for each kind of crime might save time, but to be fairer, it should be investigated thoroughly before making punishing decisions.
