They nodded by way of asking if it was okay to go on.

From my little bit of research, I've found 'by way of' is usually followed by a noun, not a verb, the example sentence in my dictionary is 'she rolled her eyes by way of an answer' which would make my sentence incorrect.
But I might be wrong.
