Brother of his

Can one say:
1-I saw the brother of his who is an engineer.
instead of:
2-I saw that brother of his who is an engineer.

Can one say:
3-I saw the brother of John's who is an engineer.
instead of:
4-I saw that brother of John's who is an engineer.

"1" seems incorrect to me but I am not at all sure about "3".
