Is this usage of "be" correct?

Can we write (1) as -

2.This relation exists whatever are the number of sides in the polygon.

Which one is the correct (1) or (2)?

Yes. Old-fashioned use of the subjunctive.

This is a more modern phrasing:
2.This relation exists regardless of the number of sides in the polygon.

Neither of those are used these days. You can leave out 'be' or 'are':
