I consider based on a participial phrase, but I see it used as a preposition all the time:

Based on the latest research in genetics, the new book is worth reading. RIGHT

Based on the latest research in genetics, I'd say Dr. Venter was mistaken. WRONG

The second should read:

On the basis of the....
