As if they Murder/Murdered

Hello

I have a question about "as if" can you please explain to me why we would use "murder" and not "murdered" in this sentence?

The legal system is throwing the book at them as if they "murder" someone.

ohh boy.. and here I am.. sitting and stressing trying to figure out why the original writer used "murder" but not "murdered".
