ARGUMENTATIVE WRITING- IELTS TASK 2

Please give me some comments about the ideas ,reasons as well as language uses. Thanks a lot.

Some people believe that there should be fixed punishments for each type of crime. Others, however, argue that the circumstances of an individual crime, and the motivation for committing it, should always be taken into account when deciding on the punishment.

Discuss both these views and give your own opinion.

There have been many disputes over whether each types of criminals should be given a fixed punishments or other factors revolving the crime should be taken into consideration before the sentences are determined. Though an unchangeable sets of rules may have some merits on the surface, I personally believe that the jury will have better decisions when examining the circumstances and motivation of a crime.

On the one hand, people avocade the impose of fixed punishments on any offences for a number of reasons. A fixed sets of laws is useful to hinder the jury from being prejudice against or towards some criminals. It is universally true that members of jury are all mortals with emotion and personal opinions, which may cause difficulties for them in giving an impartial punishment in many cases if there is no available laws for them to refer to. What is more, it is clear that the fixed laws will make it impossible for criminals to bribing in order to get away with their offences.

On the other hand, I still believe that the court should be flexible when it comes to sentences. It is because only by taking into account all the factors relevant to the crime will a member of jury have a comprehensive look into it, thereby arriving to an appropriate punishment for an violater. It is universally true that a person who commits un-attempted murder should receive a difference punishment with a person who intentionally kills someone. Another valid reason is some criminals deserve a chance to rehabilitation. To put it plainly, many people offend a serious crime while they are not in a normal state of mind, which is unfair if they are treated equally with those who had planned in advance.

All in all, though imposing fixed punishments on each type of crimes may have some advantages, namely preventing bribing, it is far more impartial and humane for them to arrive to a conclusion based on other aspects such as circumstances.
