Appeal refused, appeal failed

Hello,

can anybody please explain to me, what it means that an appeal has failed? The text goes like that:
"His family, who live in exile, have learned that he was transfered to a labour camp in April. It is assumed that an appeal against his sentence was refused or has failed."

There's not a lot of difference.
