Am/are having

1- I have problems understanding ... talks about your relation to the topic in general terms.
2- I'm having problems understanding ... talks about the fact that you repeatedly keep running into problems

3 We are having a nice time (at this moment, as I am saying this).
4 We have a nice time (whenever we get together; always; usually).


Shouldn't "have" be dynamic in 1 and 2 like it in 3 and 4?
