a short while now

Dear teachers,
Could you please help me express the following ideas correctly?:

Situation 1:Now it is 12 o'clock.Jack had a headache just about 10 minutes ago and now ( 12o'clock)he still has the headache

Jack's mother: Jack, have your dinner . It's 12 o'clock already.
Jack: : Oh, Mom.I have been having a headache a short while now / for a short moment now . You and sister Susan have lunch in advance will have my lunch later .

Situation2: Now it is 12o'clock.Mary started to feel hungry about 15 minutes ago( at 15 to 12) .
Now Mary still feel hungry.

Mary: Mom,Is lunch ready ? I have been hungry for a while now.

Situation3:In a meeting Mr Brown keeps silent all the time, but now he starts speaking when Mr Green criticizes him .

Can I say?: Mr Brown has been silent until now and now he starts to speak .

But since we can say:"I have been hungry for a while now" why can't we say:" Mom.I have been having a headache for a short while now ."?

Also,why do we have to use the past perfect here?Why can't we use present perfect?
