A puzzling question

( Must you - Do you have to ) smoke a cigarette in here? The window is locked.

I go for 'Must you' because this sentence suggests that an annoying thing is happening now, and this makes the speaker annoyed. However, my friend says 'Do you have to' is correct too. Is he right?
