A contract term: "Claim"
Hi,
I'm translating a contract faxed from the Beijing Office of a Japan client and came across a problem for the word "claim" since I don't know for the phrase "lodge claim with the seller", whether it means to raise any question to the seller or can be interpreted as compensating for the goods damage or other losses IN THE FOLLOWING contract terms. Please kindly explain, besides, please also kindly advise the meaning of the word "claim" in "...of those claims for which the insurance company..." and in "Claim for quality discrepancy". Thanks in advance!
Contract terms as follows:
QUALITY/QUANTITY/WEIGHT DISCREPANCY AND CLAIM
IN CASE THE QUALITY AND/OR QUANTITY/WEIGHT ARE FOUND BY THE BUYER TO BE NOT IN COMFORMITY WITH THE CONTRACT AFTER THE ARRIVAL OF THE GOODS AT THE . THE BUYER MAY LODGE CLAIM WITH THE SELLER SUPPORTED BY SURVEY REPORT ISSUED BY AN INSPECTION ORGANIZATION AGREED UPON BY BOTH PARTIES. WITH THE EXCEPTION, HOWEVER, OF THOSE CLAIMS FOR WHICH THE INSURANCE COMPANY AND/OR THE SHIPPING COMPANY ARE TO BE HELD RESPONSIBLE. CLAIM FOR QUALITY DISCREPANCY SHOULD BE FILED BY THE BUYER WITHIN 60 DAYS AFTER ARRIVAL OF THE GOODS AT THE WHILE FOR QUANTITY/WEIGHT DISCREPANCY CLAIM SHOULD BE FILED BY THE BUYER WITHIN 60 DAYS AFTER ARRIVAL OF GOODS AT THE .
