If the structure refers to the future, why does the correct answer refer to the past?

The structure of E) is referring to future events. A candidate must avoid being convicted in future.

The whole (correct) sentence, To be eligible, a candidate must not have been convicted of an offence means that a candidate will be ineligible if they have already been convicted of an offence.
